During negotiations, he researches property histories, existing mortgages, tax records, comparable sales, and even the opposing agent. “When I get into negotiations, I want to help my client make better informed decisions on offer price or pricing strategy.”
Preparation Over Everything
Mayer identifies preparation as the most critical element of negotiation, especially for first-time buyers. “You’re more likely competing with other buyers than with the seller,” he says. “You need to understand not just what you qualify for, but what your competition qualifies for.”
That includes understanding how property taxes, insurance, and mortgage insurance affect monthly payments. “You could have the same payment on a $400,000 house as on a $350,000 house, depending on those factors. If you don’t understand that upfront, you might focus on the wrong things.”
He recommends buyers contact him two months before purchasing to optimize financing, explore grant programs, or tap into resources like the Minnesota Housing Loan’s $14,000 interest-free assistance.
For sellers, Mayer’s philosophy centers on creating competition rather than negotiating. “When multiple buyers are interested in a property, we have all the leverage. But that only happens if we price correctly from the start.”
The Getting to Yes Framework
Mayer’s approach draws from the negotiation classic Getting to Yes, particularly its principle of separating people from problems. When repair disputes arise, he pushes for objective criteria. “Let’s get a third-party contractor to tell us what the repair actually costs. Oh, it’s $2,300? Let’s put that together. Your buyer can choose: a $2,300 credit, or we’ll hire the contractor ourselves.”
This requires emotional intelligence, which Mayer considers essential. “We create stories in our minds about what people on the other side are trying to do. Those stories usually aren’t true. It’s more about their situation than yours.”
Quick Thinking Matters
In one recent case, Mayer represented a buyer in a four-offer situation. When the listing agent said the decision would wait until morning, Mayer called his buyer to get permission to probe further. “What would make the difference?” The answer: an adjusted closing date. By shifting the closing just a few days without changing the price or terms, his buyer secured the home that night.

One came back at $420,000 immediately. “We didn’t get the full $425,000, but we got a fair deal without waiting.”
Vetting Your Agent
Mayer’s advice for choosing an agent is straightforward: look for someone handling meaningful volume annually, ask about negotiation credentials, read reviews carefully, and ensure the person you hire is the one who’ll actually represent you.
“On large teams, you might hire someone who’s done 100 deals on paper,” he explains. “But they might have ten agents underneath them. Make sure the agent you’re hiring handles your negotiations personally.”
With over 500 deals in his career, Mayer still encounters new situations regularly. His approach offers a clear framework: credentials matter, preparation beats pressure, and objective criteria trump ego.
