b. By requesting a quote or selecting a service provider to be connected with, you are opting in to communication from that service provider. Your submitted information, along with descriptions of your project and other relevant collected information, will be provided to the selected service provider.

 c. If you request services from our team – including requests to match you with service providers, either via phone, email, form, or other medium – information collected during may be used in a manner similar to information submitted through our platform. All use, registration, and disclosure of this information shall be conducted in accordance with applicable laws, ensuring that no harm or prejudice is caused to the user.

d. Your behavior on our site, including pages visited and actions taken, may be used to provide personalized recommendations and marketing materials.

2. Information Accuracy

a. The information provided by KeyCrew comes from a variety of sources, including publicly available records, user input, administrative review, and artificial intelligence models.

b. While we strive for accuracy and completeness in the information we provide, KeyCrew is not liable for any errors in the information or any harm arising from the use of incorrect information.

c. If you identify any errors in the information provided by KeyCrew, please report them to support@keycrew.co.  

3. User Conduct

a. You agree to use KeyCrew only for lawful purposes and in accordance with these Terms of Use. 

b. You agree not to use KeyCrew in any way that could damage, disable, overburden, or impair the site or interfere with any other party’s use of the site.

c. You may not attempt to gain unauthorized access to any part of KeyCrew or any related systems or networks.

4. Intellectual Property

a. All content on KeyCrew, including text, graphics, logos, images, software, and records created by KeyCrew, is the property of KeyCrew or its content suppliers and protected by United States and international copyright laws.

b. The KeyCrew name and logo are trademarks of KeyCrew. You may not use these marks without the prior written permission of KeyCrew.

c. Scraping and use of data from KeyCrew is strictly monitored. Any unauthorized scraping or use of KeyCrew data will be pursued to the fullest extent of the law.

5. Disclaimer of Warranties

a. KeyCrew is provided on an “as is” and “as available” basis. We make no representations or warranties of any kind, express or implied, as to the operation of the site or the information, content, materials, or products included on the site.

b. KeyCrew does not guarantee the accuracy, completeness, or usefulness of any information on the site, and neither does KeyCrew assume any liability or responsibility for any errors or omissions in such information.

6. Limitation of Liability

a. In no event shall KeyCrew be liable for any damages whatsoever, including but not limited to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this site or the linked sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arose in contract, tort, equity, restitution, by statute, at common law or otherwise.

It is the user’s responsibility to thoroughly vet and verify the qualifications and credentials of any service provider they engage through the platform.

7. Indemnification

a. You agree to indemnify, defend, and hold harmless KeyCrew from any liability, loss, claim, and expense (including reasonable attorneys’ fees) related to your violation of these Terms of Use or use of the site.

8. Data Privacy and Security

8.1 Privacy Policy: KeyCrew’s Privacy Policy outlines our data collection, use, and protection practices. By using the platform, you consent to the collection and processing of your personal information as described in the Privacy Policy.

8.2 Data Security: KeyCrew implements industry-standard security measures to protect user data from unauthorized access, alteration, or disclosure. However, no method of transmission over the internet or electronic storage is 100% secure, and KeyCrew cannot guarantee absolute security.

b. Our support team will promptly review and address your complaints or requests in accordance with our internal procedures.

10.2. Decision Binding:

By using KeyCrew’s platform, you agree to abide by the decisions made through our complaints resolution process.

10.3. Dispute Resolution:

a. In the event that a dispute arises between you and KeyCrew that cannot be resolved through our internal complaints resolution process, both parties agree to engage in mediation or binding arbitration to settle the dispute in the terms of this agreement.

b. Any dispute arising out of or relating to these Terms of Use or the use of KeyCrew’s platform shall be resolved in accordance with the laws of the State of Florida, as outlined in Section 9 (Governing Law and Jurisdiction).

11. Modifications to Terms

a. KeyCrew reserves the right to change these Terms of Use at any time. Your continued use of KeyCrew after any such changes constitutes your acceptance of the new Terms of Use.

Additional Terms for Service Providers:

1. User Verification and Eligibility

The platform is available to all service providers that provide services to the real estate industry, homeowners, and similar parties. Currently, the categories in which users can set up a platform account are somewhat limited, but all verified professionals in this area are welcome to create an account.

Account verification will be conducted by KeyCrew in accordance with best practices. In order to create or claim an account, you must submit information that is accurate and correct to the best of your knowledge. Inaccurate information could result in the removal of profiles. KeyCrew has the right to remove or modify profiles for any reason at any time. Ultimately, it is up to the platform to decide who is listed and who is not.

2. Service Provider Vetting and Responsibilities

KeyCrew uses a variety of processes to verify records. Claiming records may require any of the following: document submission, registration with an authorized email representing the brand, or a manual vetting process including a phone call or video call with a member of the KeyCrew team.

Service providers are responsible for ensuring the accuracy and completeness of their profile information, maintaining necessary licenses and certifications, and providing high-quality services to users. Service providers agree to indemnify and hold KeyCrew harmless from any claims or damages arising from their actions or services provided through the platform.

3. User-Generated Content and Reviews

Users of the platform promise not to submit incorrect information, claim to be a service provider that they are not, or otherwise list information on the platform that is not factually accurate to the best of their ability. Information submitted through the KeyCrew platform may be modified for length, brevity, or to fit into the constraints of the platform.

4. Dispute Resolution and Liability

4.1 Refund Policy: KeyCrew will review and issue refunds for leads that did not match the service provider’s criteria or were otherwise invalid. Refunds will be processed according to our refund policy and provided at the earliest available opportunity.

4.2 Limitation of Liability: KeyCrew is not liable for any disputes, losses, or damages arising from interactions between users and service providers. Users agree to indemnify and hold KeyCrew harmless from any claims or demands related to their use of the platform or services provided by third parties.

4.3 Dispute Resolution: In the event of a dispute between users or between a user and KeyCrew, parties agree to first attempt to resolve the issue through good faith negotiations. If a resolution cannot be reached, the dispute will be subject to binding arbitration in accordance with the rules of the American Arbitration Association.

5. Payment Processing and Refunds

5.1 Payment Processing: KeyCrew uses secure third-party payment processors to handle all transactions on the platform. Users agree to provide accurate payment information and authorize KeyCrew to charge their stored payment method for any fees or services purchased through the platform.

5.2 Subscription Billing: Service providers may be subject to subscription fees for using KeyCrew’s platform. By subscribing, you authorize KeyCrew to automatically charge your stored payment method on a recurring basis until you cancel your subscription.

5.3 Refund Policy: KeyCrew will issue refunds for invalid leads or services not rendered according to our refund policy. Refund requests must be submitted within 30 days of the transaction date. Refunds will be processed to the original payment method used.

6. Termination and Suspension of Accounts

6.1 Termination by User: Users may request to terminate their account at any time by contacting KeyCrew support. Account termination will result in the deletion of the user’s profile and any associated data.

6.2 Termination by KeyCrew: KeyCrew reserves the right to suspend or terminate user accounts for any reason, including but not limited to violation of these Terms of Use, fraudulent activity, or inactivity. KeyCrew will notify the user of the termination and provide an opportunity to appeal the decision, if applicable.

6.3 Consequences of Termination: Upon termination, users will lose access to the platform and any associated services. KeyCrew is not liable for any losses or damages resulting from account termination.
